1. DEFINITIONS

By using any service from Quero Automação, you declare that:

3.2. Nature of Services

Important:

  • Quero Automação acts as manufacturer and distributor of products sold in its stores
  • Quero Automação is a service provider related to the app and courses
  • Some devices are supplied by third-party partners and manufacturers
  • Product warranties follow Warranty and Return policies and Brazilian legislation

3.3. Service Availability

Services are available:

  • ✅ 24 hours a day, 7 days a week (Platform and App access)
  • ✅ Support: Monday to Friday, 9 AM to 5 PM (Brasília time)
  • ⚠️ We reserve the right to perform scheduled maintenance without prior notice

4. CAPACITY TO CONTRACT

4.1. Legal Capacity

To use Quero Automação’s services, you must:

  • ✅ Be at least 18 years old
  • ✅ Have full civil capacity to contract
  • ✅ Comply with Brazilian legislation
  • ✅ Provide true and accurate information

4.2. Minors

⚠️ ATTENTION – MINORS UNDER 18 YEARS OLD

Minors under 18 years old CANNOT create accounts or use services without authorization and supervision from parents or legal guardians.

If you are under 18 years old:

  • ❌ Do not create an account in your own name
  • ✅ Ask your parents or guardians to create the account
  • ✅ Use services only under the supervision of a responsible adult

Parents or guardians are fully responsible for acts performed by minors under their responsibility.

4.3. Legal Entities

Legal entities may use our services, provided that:

  • ✅ They are properly established and registered with a Tax ID
  • ✅ Registration is done by a legal representative with appropriate authority
  • ✅ They provide corporate documentation when requested

4.4. Prohibitions

The following CANNOT use our services:

5. REGISTRATION AND USER ACCOUNT

  4. Confirm your email through the sent link

By creating an account, you agree and accept these Terms of Use and our Privacy Policy.

5.4. Account Security

5.6. Account Suspension and Cancellation

Quero Automação may suspend or cancel your account if:

  • ❌ There is suspicion of fraud
  • ❌ There is suspicious or irregular activity
  • ❌ You violate third-party rights
  • ❌ By court order or competent authority

5.7. Non-Transferability of Account

  • Allow other people to use your account

6.7. Order Receipt

⚠️ IMPORTANT – WHEN RECEIVING THE ORDER

You must:

  • ✅ Check the integrity of the packaging
  • ✅ Verify that products match the order
  • ✅ Check quantities and specifications
  • ✅ Record any damage in the presence of the delivery person
  • ✅ Keep the invoice and packaging for 7 days

In case of problems:

  • ✅ DO NOT refuse delivery without contacting our support
  • ✅ Photograph any visible damage
  • ✅ Contact us immediately
  • ✅ Inform the order number and describe the problem

6.8. Invoice

All purchases include:

  • ✅ Electronic Invoice (NF-e) sent by email
  • ✅ DANFE (simplified version) inside the packaging
  • ✅ Issuance in accordance with current legislation

7. HOME AUTOMATION COURSE

7.1. Course Description

Our course offers:

  • 📝 Supplementary educational materials (PDFs, e-books)
  • 💻 Access to online teaching platform
  • 👨‍🏫 Pedagogical support

7.2. Content Access

After course purchase confirmation:

  • ✅ You will receive an email with access instructions
  • ✅ Course access will be released immediately
  • ✅ You can access content for the contracted period
  • ✅ The period starts counting from access release

Access modalities:

  • Lifetime access (permanent)
  • Access for a determined period (12 months, 6 months, etc.)
  • As specified in the course description

7.3. Certificate

To obtain the certificate:

  • ✅ Complete 100% of classes
  • ✅ Have payment up to date

About the certificate:

  • ✅ Digital format (PDF)
  • ✅ Available for download on the platform
  • ✅ Valid throughout national territory
  • ✅ Contains workload and curriculum

7.4. Student Responsibilities

As a student, you must:

  • ✅ Keep your access credentials confidential
  • ✅ Not share course content with third parties
  • ✅ Respect copyright of materials
  • ✅ Use the platform appropriately
  • ✅ Participate respectfully in interactions with other students

7.5. Course Intellectual Property

IT IS STRICTLY PROHIBITED TO:

  • ❌ Reproduce educational materials
  • ❌ Share login and password
  • ❌ Distribute content by any means
  • ❌ Use content for commercial purposes
  • ❌ Reverse engineer systems

Violations may result in:

  • ❌ Immediate suspension or cancellation of access
  • ❌ Loss of right to certificate
  • ❌ Civil and criminal liability
  • ❌ Obligation to indemnify for damages caused

8. QUERO AUTOMAÇÃO APP

8.1. App Features

The Quero Automação app allows:

  • 📱 Remote control of IoT devices
  • ⏰ Creation of customized routines and automations
  • 📊 Real-time energy consumption monitoring
  • 🔔 Receive notifications and alerts
  • 👥 Share access with family members (when applicable)
  • 📈 View device usage history
  • 🌐 Integrate devices from multiple manufacturers
  • 🎨 Customize scenarios and environments

8.2. License of Use

By installing and using the app, you receive a license that is:

  • Non-exclusive: Other users can also use it
  • Non-transferable: Linked to your personal account (access email)
  • Limited: Check App limits at this link
  • Revocable: We may cancel in case of Terms violation

8.3. Technical Requirements

The app is compatible with devices that follow supported protocols. Before purchasing an IoT device, verify:

  • ✅ Product technical specifications
  • ✅ Connectivity requirements

We are not responsible for:

  • ❌ Incompatibility of non-approved devices
  • ❌ Problems caused by third-party devices
  • ❌ Failures in devices outside specifications

8.5. You as Data Controller

⚠️ ATTENTION

When you use the Quero Automação App to monitor or collect data from third parties through IoT devices (cameras, sensors, etc.), YOU act as DATA CONTROLLER, and Quero Automação acts only as DATA PROCESSOR.

This means that YOU are responsible for:

  • ✅ Obtaining consent from monitored persons
  • ✅ Informing about data collection and use
  • ✅ Ensuring legitimacy of monitoring
  • ✅ Respecting third-party privacy
  • ✅ Complying with LGPD and other applicable laws
  • ✅ Maintaining record of obtained consents

Examples:

  • Cameras that record visitors or employees
  • Sensors that monitor family members’ presence
  • Devices that collect third-party data

You may be held civilly and criminally liable for improper use of devices.

8.6. Service Limitations

You acknowledge and agree that:

  • ⚠️ The app depends on internet connection
  • ⚠️ Functionality depends on third-party servers
  • ⚠️ Temporary interruptions may occur
  • ⚠️ Some features depend on subscription (if applicable)
  • ⚠️ Quero Automação does not guarantee 100% uptime

9. PAYMENTS

9.1. Transaction Security

For your security, we may request:

  • ✅ Proof of residence
  • ✅ Photo holding the document
  • ✅ Confirmation of card ownership

These measures are to protect you and prevent fraud.

9.2. Price Changes

Prices displayed on the Platform:

  • ✅ Are subject to change without prior notice
  • ✅ Are valid only at the time of purchase
  • ✅ Obvious errors may be corrected
  • ✅ Promotions have a determined period

10. CANCELLATION AND REFUND POLICY

10.1. Right of Withdrawal (Brazilian Consumer Defense Code)

According to the Brazilian Consumer Defense Code (Art. 49), you have the right to withdraw from the purchase within 7 (seven) calendar days from:

Refund:

  • ✅ Shipping value will be refunded
  • ✅ Timeframe: up to 60 days after request
  • ✅ Same payment method used for purchase

10.2. Order Cancellation

Before Shipping:

  • ✅ You can cancel free of charge
  • ✅ Request via website, app, or customer service
  • ✅ Full refund within 60 days

After Shipping:

  • ✅ You can refuse receipt
  • ✅ Or request return within legal period
  • ✅ Product will be returned to sender

10.3. Course Cancellation

📚 Course Cancellation Policy

Within 7 days of purchase:

  • ✅ Full refund
  • ✅ Even if you accessed the content
  • ✅ According to Right of Withdrawal

After 7 days of purchase:

  • The 7-day right of withdrawal applies
  • After this period, there is no refund

10.4. Subscription Cancellation (if applicable)

If there are subscription plans in the future:

  • ✅ Access remains until the end of paid period
  • ✅ No proportional refund after 7 days
  • ✅ Cancellation prevents automatic renewal charge

10.5. Defective Products

If the product has a manufacturing defect:

Within the contractual warranty period (1 year):

  • ✅ Repair time: up to 30 days

    • Full refund
    • Proportional price reduction

  • Pix/Boleto: Deposit within 10 business days after approval
  • Maximum total time: 60 days (according to CDC)

11. INTELLECTUAL PROPERTY

The following are the exclusive property of Quero Automação:

  • ✅ Logos, trademarks, and symbols
  • ✅ Platform layout and design
  • ✅ Systems source code
  • ✅ Database
  • ✅ Course content (video lessons, texts, exercises)
  • ✅ Marketing materials
  • ✅ Original photographs and illustrations
  • ✅ Texts and product descriptions

All protected by Brazilian intellectual property legislation (Law 9.610/98, Law 9.279/96, and others).

11.2. Permitted Use

You may:

  • ✅ Browse and view Platform content
  • ✅ Download materials expressly made available for this purpose
  • ✅ Share links to our pages
  • ✅ Print pages for personal and non-commercial use

11.3. Prohibited Use

  • Modify or create derivative works

  • Extract data through bots, crawlers, or scrapers

Violations may result in:

  • Account suspension or cancellation
  • Legal action for copyright infringement
  • Obligation to indemnify for damages caused
  • Criminal liability (when applicable)

11.4. Third-Party Property

The Platform may contain:

These elements remain the property of their respective owners. Their use on the Platform is authorized through license or legal permission.

11.5. User-Generated Content

12.2. Platform Availability

Quero Automação strives to keep the Platform available 24/7, however:

  • ⚠️ We do not guarantee uninterrupted availability
  • ⚠️ Scheduled maintenance may occur (without prior notice)
  • ⚠️ Unforeseen technical failures may occur
  • ⚠️ We depend on third-party services (internet, hosting, etc.)

In case of unavailability:

  • ✅ We will work to restore service as quickly as possible
  • ✅ We will inform about the problem when relevant
  • ❌ We are not responsible for damages arising from unavailability

12.3. User Requirements

To properly use the Platform, you must:

  • ✅ Have stable internet connection
  • ✅ Use updated browser (Chrome, Firefox, Safari, Edge)
  • ✅ Enable JavaScript
  • ✅ Accept essential cookies
  • ✅ Have updated security software (antivirus, firewall)

  • Outdated or inadequate equipment
  • Unstable internet connection
  • Incompatible browsers
  • Security software that blocks functionalities
  • Viruses or malware on user’s equipment

13. PROHIBITED CONDUCT

  • Use the Platform for any illegal purpose
  • Violate laws, regulations, or third-party rights
  • Promote criminal activities
  • Launder money or finance illicit activities

🚫 Fraud and Falsification

  • Provide false or misleading information
  • Use third-party identities without authorization
  • Use fraudulent credit cards or payment methods
  • Create multiple accounts to obtain undue advantages
  • Manipulate rating or ranking systems

🚫 Attacks and Interference

  • Attempt to access restricted Platform areas
  • Perform denial of service (DDoS) attacks
  • Inject malicious code (viruses, malware, trojans)
  • Reverse engineer systems
  • Bypass security measures
  • Intentionally overload servers
  • Use bots, scrapers, or automated tools without authorization

🚫 Intellectual Property Violation

  • Copy, reproduce, or distribute content without authorization
  • Improperly use protected trademarks, logos, or elements
  • Pirate courses or materials
  • Share access credentials

🚫 Offensive Conduct

  • Publish offensive, defamatory, or slanderous content
  • Practice discrimination, racism, or prejudice
  • Engage in harassment, bullying, or stalking
  • Publish pornographic or obscene content
  • Incite violence or hatred

🚫 Spam and Unauthorized Advertising

  • Send spam or unsolicited communications
  • Advertise third-party products/services without authorization
  • Promote pyramid schemes or fraud

🚫 Unauthorized Commercial Use

  • Resell purchased products as if they were Quero Automação
  • Use the Platform for commercial purposes without authorization
  • Extract data for competitive purposes

13.2. Consequences

Practicing any prohibited conduct may result in:

  • ⚠️ Temporary account suspension
  • ⚠️ Permanent suspension (ban)
  • ⚠️ Order cancellation
  • ⚠️ Loss of credits and benefits
  • ⚠️ Notification to competent authorities
  • ⚠️ Legal action for damages caused
  • ⚠️ Civil and criminal liability

14. PRIVACY AND DATA PROTECTION

15. RESPONSIBILITIES AND LIMITATIONS

15.1. Quero Automação Responsibilities

Quero Automação commits to:

  • ✅ Deliver products as described
  • ✅ Process orders correctly
  • ✅ Protect your personal data
  • ✅ Provide adequate support
  • ✅ Respect consumer rights
  • ✅ Meet informed deadlines (except unforeseen circumstances)
  • ✅ Honor legal and contractual warranties

15.2. Limitations of Liability

⚠️ Quero Automação is NOT responsible for:

📱 Devices and Compatibility

  • Incompatibility of third-party IoT devices
  • Failures in non-approved devices
  • Problems caused by improper use of equipment
  • Damage to devices from poor installation
  • Damage caused by humidity, temperature, and other harmful elements to equipment

🌐 Connectivity and Third-Party Services

  • Internet or provider failures
  • Unavailability of third-party services (cloud, APIs)
  • Payment gateway problems
  • Interruptions caused by force majeure

👤 User Actions

  • Improper use of Platform or products
  • Sharing credentials
  • Incorrect device installation
  • Damage caused by negligence
  • User violation of third-party privacy

💻 Technical Issues

  • Viruses or malware on user’s equipment
  • Incompatibility of outdated browsers
  • Data loss due to user failure

📦 Carrier

  • Delays caused by carrier
  • Strikes or stoppages
  • Weather problems preventing delivery
  • Incorrect address provided by buyer

15.3. Exclusion of Damages

To the maximum extent permitted by law, Quero Automação will not be liable for:

  • ❌ Loss of profits
  • ❌ Indirect or consequential damages
  • ❌ Data loss
  • ❌ Moral damages (except if proven willful misconduct or gross negligence)
  • ❌ Damages caused by fortuitous event or force majeure

This limitation does not affect rights guaranteed by the Consumer Defense Code.

15.4. Force Majeure

We will not be held liable for non-compliance with obligations due to:

  • ⚡ Natural disasters (floods, earthquakes, etc.)
  • ⚡ Wars, terrorism, riots
  • ⚡ Strikes or stoppages
  • ⚡ Government actions
  • ⚡ Power or telecommunications failures
  • ⚡ Pandemics or epidemics
  • ⚡ Other events beyond our reasonable control

15.5. Indemnification

You agree to indemnify and hold harmless Quero Automação, its directors, employees, and partners from:

  • Third-party claims arising from your use of the Platform
  • Your violation of these Terms
  • Your violation of third-party rights
  • Improper use of products or services
  • Damages caused by your actions or omissions

16. WARRANTIES AND RETURNS

16.1. Legal Warranty

According to the Consumer Defense Code:

  • ✅ Durable products: 90 days legal warranty
  • ✅ Non-durable products: 30 days legal warranty
  • ✅ Period starts from product receipt
  • ✅ Covers apparent and hidden defects

Within this period, you can:

  • Demand product replacement
  • Demand full refund
  • Demand proportional price reduction

16.2. Contractual Warranty

In addition to legal warranty, products have manufacturer’s contractual warranty:

  • ✅ Total period: 12 (twelve) months
  • ✅ Being: 90 (ninety) days legal warranty + 9 (nine) months contractual warranty
  • ✅ Start of counting: From purchase date on invoice
  • ✅ Valid throughout national territory
  • ✅ Covers manufacturing defects
  • ✅ Complete details in Warranty Term accompanying the product

16.3. Warranty Coverage

The warranty exclusively covers:

  • ✅ Manufacturing defects proven by technical analysis
  • ✅ All parts, pieces, and original product components
  • ✅ Manufacturing defects affecting operation
  • ✅ Malfunction arising from manufacturing failures

Solution: Exchange of defective product for new one or repair at Authorized Service, according to technical evaluation.

16.4. Warranty Exclusions

❌ The warranty DOES NOT cover:

a) Improper use or negligence:

  • Damage caused by misuse, negligence, or accidents
  • Use not in accordance with User Manual
  • Incorrect installation or in inappropriate location

b) External agents:

  • Natural phenomena (lightning, floods, landslides, windstorms)
  • Variation or overvoltage in electrical network
  • Excessive humidity or infiltration
  • Chemical, electromagnetic, or animal influence (insects, rodents)

c) Natural wear:

  • Natural wear of parts, pieces, and components from use
  • Aesthetic deterioration that does not affect operation

d) Product violation:

  • Violated, tampered product or with broken seals
  • Altered, defaced, or removed serial number
  • Repair by unauthorized technician

e) Unauthorized modifications:

  • Hardware or software alterations
  • Installation of non-original components

f) Digital security:

  • Fraud, invasions, hackers, or sabotage attempts
  • Loss of stored data or information
  • Viruses or malware

16.5. How to Activate Warranty

Step by step:

  2. Inform order number and problem description
  3. Provide photos/videos of defect (if requested)

  6. Wait for result: repair, exchange, or refund

Timeframes:

  • Technical analysis: up to 30 days
  • If repair is not possible: immediate replacement or refund

⚠️ IMPORTANT: Only Services Authorized by Quero Automação can examine and repair the product during the warranty period. Repair by unauthorized third parties completely voids this warranty.

16.6. Installation and Configuration

⚠️ ATTENTION:

  • Installation must strictly follow the Product Manual and/or Installation Guide provided
  • Products requiring technical installation must be installed by qualified and reputable professionals
  • Installation, configuration, and labor costs are NOT included in product value
  • Incorrect installation may result in loss of warranty

16.7. Home Service

If you request home service:

  • ✅ Consult previously the technical visit fee at the Authorized Service
  • ✅ Product transportation and security (round trip) are customer’s responsibility
  • ✅ If no manufacturing defect is found, customer will bear the costs

16.8. Total Loss of Warranty

The warranty will be completely voided in the following situations:

  • ❌ Defect caused by consumer or third parties (not manufacturing)
  • ❌ Use not in accordance with manual or technical specifications
  • ❌ Violated product or with broken seals
  • ❌ Altered serial number
  • ❌ Repair by unauthorized technical service
  • ❌ Exposure to extreme conditions not provided in specifications
  • ❌ Damage by external agents (lightning, floods, humidity, etc.)

16.9. Consumer Responsibilities

  • Data protection: Regularly back up all data. Warranty DOES NOT cover data loss
  • Digital security: Keep software updates current and network protections active against invasions
  • Preservation: Keep Invoice and original packaging throughout warranty period
  • Documentation: Provide photos or videos of defect when requested by support

16.10. Limitations and Exemptions

⚠️ Quero Automação is NOT responsible for:

  • ❌ Product installation
  • ❌ Fraud or sabotage attempts
  • ❌ Invasions or cyber attacks
  • ❌ Damage caused by third parties
  • ❌ Loss of profits or indirect damages
  • ❌ Incompatibility with non-approved third-party devices

Electronic equipment: By their nature, electronic and connected equipment are not free from fraud, tampering, or interference that may affect their operation. The consumer must adopt appropriate security measures.

17. SANCTIONS AND ACCOUNT SUSPENSION

17.1. Violations Subject to Sanction

Quero Automação may apply sanctions in case of:

  • ❌ Violation of these Terms of Use
  • ❌ Violation of Privacy Policy
  • ❌ Prohibited conduct described in section 13
  • ❌ Providing false information
  • ❌ Suspicion of fraud
  • ❌ Illegal activities
  • ❌ Harm to third parties or Quero Automação
  • ❌ Abusive use of Platform

17.2. Types of Sanctions

Sanctions may include:

⚠️ Warning

  • Formal notification about violation
  • Guidance for regularization
  • Record in account history

⚠️ Temporary Suspension

  • Access block for determined period (days/weeks/months)
  • Inability to make purchases
  • Restriction of app access
  • Suspension of courses in progress

⚠️ Permanent Suspension (Ban)

  • Definitive account cancellation
  • Loss of all benefits and credits
  • Inability to create new account
  • Tax ID blocked for new registrations

⚠️ Other Measures

  • Cancellation of orders in progress
  • Retention of amounts (in case of fraud investigation)
  • Notification to competent authorities
  • Legal action for damages caused

17.3. Application Process

Before applying serious sanctions:

  • ✅ We will carefully analyze the situation
  • ✅ We will give opportunity for defense (when applicable)
  • ✅ We will notify about applied sanction
  • ✅ We will inform deadline and conditions for regularization (if any)

Exceptions (immediate sanction):

  • Proven fraud
  • Illegal activities
  • Imminent risk to other users
  • Court order

17.4. Right of Appeal

You can contest a sanction:

  • ✅ Present evidence or justifications
  • ✅ Wait for analysis (deadline: up to 15 business days)

The final decision rests with Quero Automação.

17.5. Suspension Consequences

In case of permanent suspension:

  • ❌ Loss of access to all services
  • ❌ Loss of credits, coupons, and benefits
  • ❌ Courses in progress will be cancelled
  • ❌ There will be no refund of amounts (except when required by law)
  • ❌ Orders in progress may be cancelled

Exception: If suspension is unjustified and demonstrably incorrect, we will proceed with proportional refund.


18. MODIFICATIONS TO TERMS

18.1. Right to Modify

Quero Automação reserves the right to modify these Terms of Use at any time to:

  • ✅ Reflect changes in our business practices
  • ✅ Adapt to new laws and regulations
  • ✅ Incorporate new services or functionalities
  • ✅ Improve clarity and understanding
  • ✅ Correct errors or inconsistencies

18.2. Change Notification

When there are relevant changes:

  • ✅ We will update the “Last updated” date
  • ✅ We will send notification by email (significant changes)

18.3. Acceptance of Changes

You have two options:

✅ Accept Changes

  • Continue using the Platform normally
  • Your use after entry into force = tacit acceptance

❌ Do Not Accept Changes

  • You must notify us within 5 days of publication

  • Your account will be closed under previous Terms
  • You will lose access to services

If there is no manifestation within 5 days, you will be considered to have accepted the changes.

19. GENERAL PROVISIONS

19.1. Entire Agreement

These Terms, together with the Privacy Policy and other related documents, constitute the entire agreement between you and Quero Automação.

19.2. Independence of Clauses

If any provision of these Terms is deemed invalid or unenforceable:

  • ✅ The invalid provision will be interpreted as close as possible to the original intent
  • ✅ The rest of the agreement will not be affected

19.3. Assignment

You cannot:

These Terms of Use are governed by the laws of the Federative Republic of Brazil, especially:

20.2. Choice of Jurisdiction

To resolve any disputes arising from these Terms of Use, the jurisdiction of São Paulo, State of São Paulo, Brazil, is elected, to the exclusion of any other, however privileged it may be.

Exception: For consumer relations, the consumer may opt for the jurisdiction of their domicile, as provided in the Consumer Defense Code.

20.3. Dispute Resolution

In case of doubts or conflicts:

  2. Mediation: We may suggest mediation or arbitration (optional)
